We are pleased to advise that Te Ohu Kaimoana and Ngāi Tahu were successful in gaining interim orders to prevent the proposed increase in the PAU 5B TAC and TACC, and reallocation of settlement rights.
The matter was considered by His Honour Justice Churchman on late Friday afternoon with interim orders being made at approximately 4.30pm.
We note that the Crown consented to the application and did not seek to oppose us on this matter.
This is an important interim success in terms of delaying any trigger of s 28N rights in the PAU 5B fishery for the forthcoming fishing year, however, work needs to continue to find a resolution to the overall issue of 28N Rights. Te Ohu Kaimoana is hopeful that the Crown’s cooperation in this matter signals an increased urgency on its part to find that resolution and protect the integrity of the settlement.
Te Ohu Kaimoana remains committed to working with the Crown through the 28N Rights Working party to find a solution which protects Iwi rights and respects the interests of 28N Right Holders.
